Since ASCAP owns the rights to the song “Happy Birthday”, can they legally charge each of us for singing it?

Incredibly, ASCAP and BMI are going after small businesses (bars and clubs) to charge fees when bands perform cover tunes in their establishment (DOH!)… not nickel/dime mind you, I’m talkin’ big hits (per seat)! I was just wondering… if they have the audacity to extort those people, why stop there? Why don’t they drive around looking for balloons, show up to each birthday party and demand royalties from each family member for singing a copyrighted song?

THEY are snuffing out the music business. Small cover bands, live music… have they hit the DJs yet? You wonder how musicians can learn their craft anymore (not when small club owners balk at paying the extortion fee).

I personally believe that these bands pay tribute AND benefit these artists, providing free advertising for the artist via performing those songs! If someone heard a tune played by a bar band, it might prompt them to go buy a CD from the artist!

Maybe? Hmmmmmmmm? ASCAP and BMI? C’mon now.

They don’t charge people for singing songs in the privacy of their own homes. You can sing anything you want in your own house without being charged. The problem arises when you charge others to hear you sing the song. Copyrights are put in place to protect the work of the original song writer. Because songs are copyrighted the ASCAP and BMI have every right to charge royalties when their songs are sung. It’s like when companies develop new technologies, they copyright them so that their competitors don’t steal the information and develop the same thing. Music is no different. My advice to musicians: go ahead and play the songs when you are just starting out, but when you get good enough to get a gig it’s time you start writing your own songs. If you absolutely feel the need to play someone else’s work, check out the copyright laws. There are some instances where you can play copyrighted songs, and if you aren’t in one of those situations, take the necessary steps to get permission.
