Free Music Rapidshare Downloads
How legal is rapidshare.com?
Is downloading music from rapidshare very legal? I know its technically illegal to download copyright material for free, but i’ve heard that rapidshare makes it legal by limiting downloads for free users and showing you a bunch of ads and stuff before you download. Have people ever been sued for downloading (not uploading) from rapidshare? I downloaded some albums over the span of a month or so, and i want to make sure i’m not in trouble.
It’s quasi-legal (as far as THEIR liability goes) by the old “we aren’t responsible for what our users do” excuse. So far the courts have been unwilling to make baby sitters out of web site owners.
It’s completely illegal for you to HAVE a copy of material that’s copyrighted without the copyright owner’s permission (which is what you’re buying when you buy a CD or DVD – the plastic costs a few cents retail). Downloading copyrighted material without paying for it is the violation – regardless of limits, ads or anything else. Unless they’re paying the copyright holder for every download (which they most likely aren’t), the downloads are evidence of a crime. AND could subject YOU to a suit by the RIAA (and they seldom lose – I’ve heard of only 1 case, and the decision was legally unsound.)
